A landlord of a commercial building includes in their lease a requirement that their tenants maintain commercial general liability (CGL) insurance with a limit of no less than $2 million. The landlord must be named as an additional insured under the tenant’s CGL policy, and the policy must be primary and noncontributory with respect to any policies carried by the landlord.

Historically, the ARD was designed to control the effective period for an employer’s workers’ compensation rates and experience modification factor.

The following is a common claim scenario for our general contractor and subcontractor clients: A general contractor hires a subcontractor to complete work on the construction of a building. A few years after the construction is completed, the building owner alleges there are defects in the construction, and makes a claim against the general contractor. The sole focus of the claim is the work of the subcontractor. The allegedly defective work did not cause damage to any other part of the building.
