As we near the end of 2023, we’ll focus on two reporting requirements that apply to most employers offering group health plan coverage. A new requirement, gag clause attestations indicating that contracts do not contain prohibited gag clauses, are due for the first time by December 31, 2023. We’ll walk through the attestation requirements and how employers attest if needed. We’ll spend the rest of the webinar providing a refresher and discussing some of the changes for reporting offer of coverage and enrollment information early in 2024 on Forms 1094 and 1095.
